About the Author
Michael P. Davis maintains a construction law practice and
represents a wide variety of trade contractors, prime
contractors, owners/developers and design professionals. His
practice focuses primarily on construction contract disputes in
state or federal courts, arbitrations and mediations throughout
the United States. He has successfully represented a broad
spectrum of specialty trade contractors and prime contractors in
a variety of construction disputes involving construction
defects, delay and labor inefficiencies, UCC warranty issues,
constructive accelerations, and increased scope of work. Mr.
Davis has been a member of the Construction Industry Panel of
the American Arbitration Association since 1991 and has served
as sole arbitrator in numerous cases. In addition, Mr. Davis has
significant experience in labor and employment law, including
matters involving unfair labor practices, union election
campaigns, safety violations, overtime claims, employment
discrimination, and restrictive employment covenants.
Nicholas S. Papleacos has more than 28 years' experience
in construction law and litigation throughout the country. He
maintains a national construction law practice, representing
specialty trade contractors including those involved in
coatings, mechanical and electrical work, as well as general
contractor clients. He has represented contractors in disputes
in state and Federal court trials and in arbitration
proceedings, as well as against federal and state agencies. He
is a member of the Southern Polytechnic State University
Foundation and teaches construction law in the Construction
Management Department.
Seth R. Price possesses significant experience in the
field of construction law. Since 1982, his practice has
emphasized the resolution of large, complex construction
contract disputes in state and federal courts and through
arbitration. When resolution cannot be obtained through
negotiation and/or mediation, he has successfully arbitrated and
litigated cases with amounts in dispute up to $50M+. Mr. Price
assists owners, contractors and subcontractors in resolving
potential and actual construction disputes. He regularly
represents owners, general contractors, subcontractors, and
suppliers in matters dealing with a wide range of legal issues.
He has successfully resolved cases including construction delay,
lost productivity, sufficiency of performance, specification and
plan interpretation, extra work, and bond claims. Mr.
Price additionally advises clients on contract terms and
provisions, assists in contract negotiations, and provides
guidance on dispute avoidance strategy.
Gina M. Vitiello has practiced construction law for 14
years. She handles legal matters involving a wide variety of
projects including hospitals, hotels, courthouses, airports,
office buildings, ambulatory surgery centers, prisons, power
plants, water treatment plants, manufacturing facilities,
educational and military facilities, retail properties and
multi-family residential complexes. Ms. Vitiello represents
clients in contract negotiation matters, dispute
avoidance/resolution and litigation. She has extensive
experience in handling large, complex construction claims
involving delay and impact damages, as well as design and
construction defect issues. She also assists in drafting
construction and commercial contracts, including general
contracts, professional service agreements, construction
management agreements, design-build contracts, subcontracts,
joint venture agreements, energy savings performance contracts,
and long-term service and maintenance agreements. She advises
clients on state, local and federal government contract and
procurement issues, as well as government bid dispute issues.
Ms. Vitiello is certified by the U.S. Green Building Council (USGBC)
as a Leadership in Environmental and Energy Design ("LEED")
Accredited Professional and counsels clients on matters relating
to sustainability, green building and green leases. |
